Roommate Agreement
(Canada)

 

 
This roommate agreement, dated _______________________ [insert date] is made by and between the following roommates as co-tenants ______________________________________   _____________________________________(hereinafter referred to as the “Roommates”). This Roommate Agreement applies to, and the Roommates residing at ________________________  ____________________________________________ [insert address of premises] (hereinafter referred to as the “premises”).
SECTION ONE
PAYMENT
 
I. AMOUNT
Absent a written agreement expressing otherwise, each roommate is responsible for an equal per capita proportion of rent owed to landlord, under the rental agreement (separate document) and subject to any lawful adjustment in rental amount.
 
II. METHOD OF PAYMENT [Check one]
 
 Rent shall be tendered, when due, to one roommate designated here ____________________

Should any roommate intend to terminate his or her tenancy, said roommate shall do so by informing the remaining roommate(s) in writing, no less than thirty (30) days before vacating the premises. Whenever possible, the vacating roommate shall reasonably assist the remaining roommate(s) in finding a suitable replacement roommate. The vacating roommate will be responsible for any and all current and outstanding charges, costs, or fees incurred by him or her during the course of his or her tenancy and/or caused as a result of the early termination of his or her tenancy.

SECTION SEVEN
GUESTS
 
Upon reasonable oral or written notice provided to all other roommates, a roommate may have an overnight guest stay in his/her room for a continuous period of up to seven (7) days. A minimum of twenty-four (24) hours shall be deemed to be reasonable notice in absence of evidence to the contrary. The actions and conduct of the guest shall be the responsibility of the “host” roommate. The host roommates guest may stay beyond seven (7) days, but only with the express consent of the other roommate(s). Should the roommate(s), at any time feel as though their comfort, safety or enjoyment, is being substantially interfered with by the guest, any roommate may revoke said guests license by informing the “host” roommate and/or the guest that the license has been revoked, as well as providing a reason for the revocation. Eight (8) hours, after having been informed, shall be deemed a reasonable amount of time for the guest to vacate the rental unit, in the absence of a substantial cause to the contrary (e.g. serious emergency, accident, etc.).
 
SECTION EIGHT
INVOLUNTARY TERMINATION OF ROOMMATE TENANCY
 
Notwithstanding any other provision of law, no roommate shall be asked, or required, by another roommate to involuntarily terminate his/her tenancy except where:
(A)   The roommate fails to pay:
a.   His/Her portion of the rent
b.   His/Her proportion of the common household expenses, charges and or costs as agreed upon in Section Three (3) of this agreement
c.   Any expenses, charges or fees individually incurred, where the late or non-payment adversely affects the other roommate(s); or
(B)   The roommate is permitting to exist, or committing, a substantial nuisance in, or causing a significant amount of damage to, the rental unit. Or is permitting to exist, or creating, a substantial interference with the comfort, safety, or quiet enjoyment of the landlord and/or other roommate(s). The nature of such nuisance, damage, or interference, and lack of an available remedy, shall be specifically stated in writing by the landlord, or the other roommate(s); or
(C)   A violation of a lawful obligation or covenant enumerated in the rental agreement has been committed, without the express permission of the other roommate(s) or landlord; or
(D)   A substantial violation of any express material agreement which may be created between him/her and the other roommate(s) occurs.
